Miami to Vegas: What are the laws for dispensaries in Sin City?

The cannabis laws governing Las Vegas, NV and the state itself, unlike a lot of the others in the country allow the purchase of both recreational and medical cannabis. Medical patients will be able to buy up to 2.5 ounces of cannabis in a two week or 14 day period. If an adult of 21 years and above wants to buy cannabis for recreational use then they can buy up to an ounce of the flower or an eighth of an ounce of concentrated cannabis. But this is what they will be able to buy each time.
This ensures that dispensaries get a lot of customers. But if you are thinking about going into the cannabis business in Las Vegas and opening up a dispensary, then there are some laws which you need to keep in mind:
- Know that a cannabis dispensary can’t be located anywhere near a thousand feet of private or public schools. They also can’t be located within 300ft of a community facility.
- Marijuana dispensaries have to be located in a completely separate facility or building which is within an industrial or commercial zone. These dispensaries have to follow the local zoning laws and such of course.
- Know that every cannabis dispensary owner, board member, officer, volunteer, and the employee will have to get an agent registration card. This can be got by just applying through the Nevada Department of Taxation. The application fee charged for each such card is $75. The card that you will get will be valid for a whole year from the date of its issue.
- You will not be able to put out misleading or false advertising statements just to advertise your dispensary or product. Along with this, you will also not be able to promote any form of overconsumption of weed.
- Nevada’s cannabis laws also prevent you from depicting the actual consumption of weed by someone under 21 years of age. This means that you won’t be able to depict a child or use images associated with children like toys, cartoons, balloons, action figures, and mascots.
- You also won’t be able to be a sponsor of any entertainment events, youth sports or teams. Along with this, you also won’t be allowed to advertise in any radio, television, publication or any other medium where the audience is expected to be under 21 years of age. In all your advertisements, you will have to add some phrases like, Keep out of children’s reach and For use by adults over the age of 21.
- Nevada laws prohibit you from placing an advertisement inside a shelter or public transport vehicle. You also won’t be able to put up an advertisement in a place if it’s not allowed by the local ordinance.
- Before selling weed to a customer, the employee or anyone else in charge will have to verify the age of the customer by checking a valid, government-issued photo ID. If the customer needs assistance or needs more info before buying a product then the staff will have to assist him or her.
After sales, the person in charge will also enter information about the product amount sold, date and time of selling the product and all additional requirements when completing the sale. Along with this, the dispensary’s license number will also have to put in the system.
